Terms & Conditions of Booking
 
Island Dream Villa

The booking terms and conditions form the sole contract between us and the person signing the Booking form, who must be over 25 years of age and who shall be deemed to sign this form on behalf of all the persons herein. No contract shall exist until we have received a signed booking form together with the correct 25% deposit payable to Paul Diggens. Or, if less than 11 weeks, the full payment and we have confirmed the reservation in writing. Your booking can be made provisionally, if required, and held for a maximum of 7 days to allow time for your completed booking form and deposit/full payment to be received. The balance should be paid not later than 11 weeks before departure. If a booking is made within the 11 week period, full payment must be received before the booking can be confirmed.

A security/breakage deposit of £300/$500 is required for the villa. This should be paid with your final balance. This is to cover "excessive" use of electricity (e.g. air conditioning on full with external doors left open), "excessive" cleaning costs and chargeable telephone calls, and also covers for damage, breakage and loss to the villa and contents. The security deposit, less any such charges, will be refunded by cheque as soon as the Management Company has completed its inventory and occupancy report. This is normally returned to you 4 weeks after your return but no later than 6 weeks after your return. Please be reassured that normal wear and tear is expected and is taken into consideration.

The accommodation rates quoted are PER WEEK (not per person) and include electricity, air conditioning, local telephone calls, cable TV, digital TV as applicable, bed linen, towels, the use of all the amenities and facilities. FLORIDA SALES AND TOURIST TAX MUST ALSO BE PAID IN ADDITION TO THE NET RATES QUOTED ON THE INVOICE. Pool heating is not included, but is an optional extra.

Please note that SMOKING IS NOT PERMITTED INSIDE THE VILLA, though it is permitted on the patio area by the pool. This keeps the villa odor free and also avoids the trouble of the sophisticated smoke detectors being triggered by the cigarette smoke, your co-operation is therefore requested and appreciated.

The accommodation may only be sub-let, shared or assigned by you with our express agreement in writing, otherwise only the persons detailed on the booking form are permitted to stay in the villa. The maximum occupancy of 16 people (plus babies under 3 yrs of age) is determined by the authorities within strict guidelines for fire safety. Please note that any contravention of the above will render your booking void and all moneys will be forfeited. No pets are allowed in the villas, unless by prior arrangement and agreement in writing.

The rental period begins at 16.00 hours on the day of arrival and terminates at 10.00 hours on the day of departure. The villa is professionally cleaned and inspected before and after each rental to ensure that all guests have a comfortable stay. Lawn and Pool care are provided on a weekly basis. Please note that each self catering villa has an initial supply of consumables (bin bags/toilet rolls/washing powder etc.) Once these have been used it is not the responsibility of the management company to replenish these items during your stay. The consumables supplied should be adequate for the first few days of your stay.

In the event that you cancel your reservation, or, we have to cancel the arrangements due to non payment of the balance due within the time allowed before departure, cancellation charges will be made as follows; Date of Cancellation (date of postmark) before arrival date Cancellation Charge (booking deposit will be deducted from this) 10-6 weeks 50% 6-4 weeks 75% 4 weeks-arrival date 100% If we are able to re-book the period you will be able to transfer payments made to another period or monies paid refunded less an administration charge of $100. Cancellations must be confirmed to us in writing. You are strongly recommended to take out adequate holiday/vacation insurance to cover possible cancellation as soon as your reservation is confirmed.

We cannot accept liability for death, personal injury, sickness, accident, delay or loss of luggage or personal effects or any other loss or misadventure which may occur whilst renting one of our villas. Use of the pool/spa, any community pool, aqua area, tennis court & recreation area's is entirely at your own risk. It is particularly important that children are supervised at all times in and around the pool areas The pool is between the depth of 3 to 6 feet. The Local authorities are considering the implementation of a $5000 fine if anyone should tamper with the door alarms. They are specifically there to safeguard your children. DO NOT switch them off!. Presently there is a safety barrier to prevent children wandering from the house into the pool. This MUST BE KEPT CLOSED, except for access under parental supervision.

Force Majeure. We accept no responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including, but restricted to, war, terrorist activity, civil commotion, flight delays or cancellations, airport closures, adverse weather conditions, fire flood, or industrial dispute. We cannot accept any liability for failure of public supplies such as water, electricity or breakdown of the air conditioning system. Nor for the consequences of the actions or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. This does not affect your statutory rights as a consumer. If, in the unlikely event you are unable to occupy the home by a major problem that cannot be solved prior to your arrival or during your stay, we would do our utmost to secure a similar home in the neighborhood. Some parts of the estate will not be completed until approximately end of 2004.This is unlikely to effect your stay but increased traffic during the working week is beyond our control. We cannot accept any liability for your personal safety during your holiday vacation. You are reminded to exercise care as to your personal safety and the safety of your companions. Whenever possible, valuables should be left secure and out of sight.

ALL OVERSEAS CLIENTS SHOULD POSSESS VALID PASSPORTS AND ANY VISA REQUIRED. British citizens require a full 10 year passport valid for a period of at least six months beyond the holiday/vacation return date. From October 2003 this includes all persons including children. The majority of visitors to the USA from Britain no longer require a visa as a result of the Visa Waiver Programme, but there could be changes to the Programme and it is the holidaymakers responsibility to ensure they have all the correct travel documents. If you have any queries you are advised to contact the US Embassy for details. We cannot accept liability for any aforementioned conditions not being met or any refusal of passage.

We reserve the right to decline or retain any person as a client whose conduct is deemed to be disrupted and affects the enjoyment of other holidaymakers/residents. We shall be under no liability to accept any costs incurred, or responsibility for, any such person. We ask that guests refrain from making undue noise before 8am and after 11pm whilst outside. Should you experience any problems whatsoever with the villa during your stay, please contact the Management Company, who will do their best to assist and rectify the matter as soon as it is practically possible. We cannot resolve a problem for you unless we/one of our agents are notified of it at the time. Please give us the "opportunity" to correct matters. Should a problem remain unresolved, you are asked to notify us in writing within 7 days of your return. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a 2 month period from receipt, the details of which will be kept confidential to only the parties involved.

Please note that as Florida is a tropical State, insects such as ants and the like are occasionally inevitable and are not cause for complaint. The villas are treated periodically as part of a pest and termite control programme, and are cleaned after each rental.
